Court Upholds Chrisman Restraining Order!

On Tuesday, November 9th, 2010, PLEA attorneys presented law enforcement testimony from responding personnel at the Chrisman hearing.  This sworn testimony from police employees gave the court a perspective on the limited information police management and the County Attorney utilized in the decision to book and indict Officer Chrisman.  Comments from the witness stand demonstrated both delay and the conflict between involved witnesses and the information presented to the grand jury.  The probable cause statement (Form IV) is being challenged as inappropriate and inaccurate by responding personnel.  Chief Harris is moving to terminate without a completed PSB investigation or a completed criminal investigation.  PLEA’s request of the court is to order the police department to wait and utilize a completed administrative and criminal product as the basis for a termination decision.

On Wednesday, November 10, 2010, PLEA received word that the Superior Court had made a decision to uphold the restraining order currently in effect against the Phoenix Police Deparment which will prohibit them from terminating officer Rich Chrisman until the criminal case against him is adjudicated.
